District Court Judge Terry McBride heard four cases on the Aug. 30 sounding docket in Pryor.
All of the cases first appeared in the courtroom of Judge Gary Dean during the preliminalry hearing stage. Each case was held over for district court arraignment and each had been reported on in The Daily Times.
A sounding docket, as defined by a criminal law information Web site, is “typically a substitute for a pretrial conference. A pretrial conference is used by the courts as a method to keep track of cases. At this conference, the main question the court wants answered is whether the case will be set for a plea, continued, or set for trial.”
The following four cases appeared before McBride on Aug. 30:
Allen Harman, 49, is charged with manufacture of a controlled dangerous substance, unlawful use of a police radio, and possession of a controlled substance, all after former conviction of a felony.
Harman had applied for a court appointed attorney and Brant Shallenburger was assigned to the case last year.
In June, however, Attorney Oliver W. Arbogast was entered as Harman’s attorney and Shallenburger withdrew from the case.
Harman appeared in court on Monday with his new attorney, and at their request, McBride continued the case to the Dec. 22 sounding docket. In addition, bond was reduced from $40,000 to $30,000. Harman remains in jail.
David Ray Fisher, 45, Peggs, is charged with three counts of rape by instrumentation. At the time of his arrest, Fisher was the principal for Chouteau Elementary School. Attorney Donn F. Baker represents him. Bound over for district court arraignment, Fisher entered a plea of not guilty in July.
Fisher appeared in court on Monday with his attorney. A continuance was granted to the Dec. 22 sounding docket. Fisher will remain free on his present bond.
Hank Daniel Clifton Montgomery, 35, Locust Grove, has been charged with first-degree rape by instrumentation, forcible sodomy and robbery with fear. The victim was 81 at the time of the assault, which occurred on May 5, 2009. Montgomery is represented by Attorney Gerald Lee.
After several pre-trial motions and multiple court appearances, a trial date was set for Aug. 2, but more delays followed. A new date was set Monday, when Montgomery appeared with his attorney. The trial date is Oct. 18. Montgomery remains in the Mayes County Jail.
Chad Allen Felts, 34, is charged with two counts of grand larceny and two counts of knowingly concealing stolen property. Winston Connor II is his attorney. Felts entered a plea of not guilty during his district court arraignment in July. He was in court again Monday with his attorney. The case was continued to the Dec. 2 disposition docket. Felts remains free on bond.
