The Chouteau Town Council discussed a house at 111 South McCracken St. at Monday night’s meeting.
Police Chief Gary Shrum showed photos of the house to the council. Shrum spoke to the owner, Mohammed Boudhir, who said he does not have the money to fix the house. Boudhir has mowed the lawn.
Town attorney Ben Sherrer told the council that Boudhir has to be notified about a public hearing regarding the house as a public nuisance. Boudhir would have to appear at that meeting. The council would then decide if the house is a public nuisance. If the council decides the house is a public nuisance, it can take action to abate the nuisance or give the owner instructions to take the structure down.
Council member Cecil Lane asked if the fact that the house has no public utilities affects declaring it a nuisance. Sherrer said it might be a violation of the town code. Mayor Jerry Floyd said there is an ordinance declaring residences in town must have utilities.
Sherrer recommended the council give Boudhir notice of a public hearing. The council approved.
The council approved a new computer for the town offices, purchased from Ages Computer for $1,380.50.
The council discussed a list of streets to be repaired and the amount to spend on materials. John Crowson talked about the cost of materials. Crowson said that the town is looking at $30,00 just for oil on the roadways to be repaired. No action was taken.
The mayor brought up seeking a Community Development Block Grant request for a new public library. Floyd said the library is too small for their needs and that a new library is needed. Council member Brenda Cunningham said, “I’m all about building a library.” No action was taken.
The mayor gave a report saying the walking trail needs some work.
After an executive session, the council hired Zach Jackson to feed and water the animals in the town shelter and clean out the kennels on Saturdays at a rate of $10 an hour effective Aug. 18. The council hired Anna Lynn to be a full-time School Resource officer at $13.90 an hour effective immediately.
The council approved a change in town ordinances regarding fines. Ordinance 2012-3 repealed section 14-60 which contains duplicative penalty language. Section 14-60 states a maximum $200 fine. Another section in the ordinance states a maximum $500 fine. The 14-60 section stating the maximum $200 fine was repealed. The council approved an emergency clause making the change effective immediately, rather than in 30 days.
The council approved changing Town Ordinance 2012-4 creating a dealers’ permit for operation of golf carts and all terrain vehicles being test driven on town streets. The council approved an emergency clause making the change effective immediately.
The council approved Resolution 2012-8 setting annual fees and issuance rules for dealer golf cart/all terrain vehicle permits. The council agreed to a dealer fee at $100. The council approved an emergency clause making the change immediate.
The council approved Resolution 2012-9 establishing reimbursement rate schedule for members of the Chouteau Volunteer Fire Department. Fire runs to be $15 per run, medical runs $5 per run. The total shall not exceed $300 per fire fighter per month. The council approved making these changes effectively immediately.
Under new business Cemetery Superin-
tendent John Crowson brought up a request by a Tulsa funeral home to erect two mausoleums in the town cemetery. The council decided against granting approval.
