CLAREMORE — Felony charges have been filed against a Claremore man arrested earlier this month in connection with the stabbing and attempted kidnapping of a convenience store clerk.
John Timothy Kapchinsky, 52, was formally charged Wednesday in a Rogers County Court with burglary in the first degree, assault and battery with a deadly weapon, and kidnapping.
On the evening of March 13, Claremore woman Erin Lackey was working at the Buy N Bye convenience store at 601 East Will Rogers Boulevard, according to Claremore Police records.
During her shift, Kapchinsky entered the store and attempted to purchase beer, but was refused a transaction as the in-store credit card machines were shut down, according to reports.
Upon being refused, Kapchinsky became angry, produced a knife and then physically grabbed Lackey, according to reports.
Moments later, Kapchinsky reportedly took a case of beer and two packs of cigarettes, during when, a struggle ensued with Lackey, and he reportedly stabbed her in the breast and took her cell phone away, reports said.
Lackey was then forced out of the store by Kapchinsky, who attempted to force her into her vehicle, but she escaped and fled the scene, reports indicate.
Lackey reported the incident to Claremore police and she was treated for injuries at a local hospital.
During their investigation, officers found evidence of a struggle at the convenience store, including knocked over displays and a broken cooler door, as well as finding the reported case of beer and two packs of cigarettes inside Kapchinsky’s vehicle.
Kapchinsky was located at a residence on East Patti Page Blvd. and arrested shortly after 2 a.m. on March 14.
He was subsequently booked into Rogers County Jail on the charges on which he was formally charged Wednesday.
Kapchinsky’s preliminary hearing has been set for Monday in the court of Judge Terrell S. Crosson.
